Who has building code jurisdiction on my project?State Buildings If the building is owned or occupied by the State of Idaho, the plans are required to be approved by the Division of Building Safety Executive Order 99-6 Schools If the building is a public school, the plans are required to be approved by the Division of Building Safety (DBS) prior to the advertisement for bids. If the project value is less than $25,000, DBS does not need to approve the plans. Local city or county building codes are not preempted by the DBS review or approval. Modular Buildings Buildings built in one place with the intent to move the building to another site for placement are under the jurisdiction of DBS for the construction that is done at the place of manufacture. Manufactured Homes Manufactured Homes (HUD) are regulated under the National Manufactured Housing Construction and Safety Standards Act of 1974, which is preemptive over construction standards established by states and local governments.
